Terms of Service

By accessing or using the Botterfly AI platform ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service.

Botterfly AI provides an AI-powered project management platform, including but not limited to: AI task generation from meeting notes, async standup management, retrospective tools, built-in CRM, MCP server integration for AI coding assistants, and team collaboration features.

To use the Service, you must register for an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials and must notify us immediately of any unauthorized access to your account.

You agree not to:

• Use the Service in violation of any applicable law or regulation
• Transmit spam, harassment, or abusive content
• Interfere with or disrupt the Service or its infrastructure
• Attempt to gain unauthorized access to any part of the Service
• Use the Service for any unlawful or fraudulent purpose
• Violate the privacy or data protection rights of any third party

Our AI services are designed to assist with project management tasks and should not replace professional judgment. Users are responsible for reviewing and validating all AI-generated content, including tasks, summaries, and suggestions. The AI features are tools to enhance productivity, not substitutes for human decision-making.

You retain ownership of all data you create or upload to the Service. We process your data solely to provide and improve the Service, as described in our Privacy Policy. We maintain compliance with applicable data protection regulations including GDPR and CCPA. You remain responsible for your own regulatory compliance obligations.

We target 99.9% uptime but do not guarantee uninterrupted access to the Service. Scheduled maintenance may occur, and we will provide advance notice when possible. We are not liable for any downtime or service interruptions.

Subscription fees are billed monthly in advance. All fees are non-refundable unless otherwise specified. We reserve the right to change pricing with at least 30 days' notice. Non-payment may result in suspension or termination of your account.

The Service, including its technology, design, and branding, is the proprietary property of Botterfly AI. You grant us a limited license to use your data solely to provide the Service. We may use aggregated, anonymized data to improve our platform and AI capabilities.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNTS PAID BY YOU IN THE PRECEDING 12 MONTHS.

You agree to indemnify and hold harmless Botterfly AI, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

Either party may terminate the agreement with 30 days' written notice. We may terminate immediately if you breach these Terms. Upon termination, your data will remain available for export for 30 days, after which it will be permanently deleted.

We may modify these Terms at any time. You will be notified of changes via email or in-app notification. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

These Terms are governed by the laws of the State of Delaware. Disputes shall be resolved through binding arbitration in Delaware, except for intellectual property claims, which may be brought in state or federal courts in Delaware.

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
